A final plat application has been submitted to replat the 8.69-acre Wilcox Subdivision, Lot 61, which is zoned Agricultural One (A-1), Adams County legacy zoning. Approval of the plat will create new residential lots, with dedicated access and utility easements, while establishing workover easements around one plugged and abandoned well on-site.

Key Issue

Lot sizes and Overlay Compliance - The project site is governed by the Transitional Area Overlay District (TOAD) pursuant to the Broomfield Municipal Code, Chapter 17-25.1. While TOAD regulations require a minimum lot size of 1.0 acre, 2 of the 8 proposed lots on the final plat do not meet this standard (Lot 5 at 0.89 acres and Lot 6 at 0.89 acres).

Process

Final Plats are reviewed by the Land Use Review Commission at a public hearing, where the commission votes to recommend approval (with or without conditions) or denial of the final plat. The Council considers the commission's recommendation during a hearing, and will either approve (with or without conditions) or deny the request.

City and County Staff Analysis

Zoning, Surrounding Uses and Comprehensive Plan: The property is zoned A-1(A) and is subject to the Transitional Overlay Area District (TOAD) as identified in the Broomfield Municipal Code, Chapter 17-25.1. The TOAD is intended to mitigate growth impacts and the resulting traffic from development on the existing neighborhood. It is intended to encourage and foster development that is compatible with the existing neighborhood. Development requirements include a minimum one-acre lot size for residential uses with a maximum building height of 35 ft. Per the A-1 (A) zone district, lot frontages must be 100 feet at the building line.

The zoning to the east and north is also A-1(A). The property to the west is zoned Planned Unit Development (PUD) and is the site of the Risen Savior Lutheran Church. The properties to the south and across from W. 144th Avenue are also zoned PUD.

These properties are not subject to the TOAD and are primarily 0.1 - 0.3 acres in size, with single-unit detached homes being located in the Broadlands and McKay Landing subdivisions.

Site Circulation and Parking: The proposed residential lots will be accessed from Federal Boulevard via a collector road that runs east/west through the subdivision with a cul-de-sac at the eastern end of the neighborhood. Parking for residential uses will be provided on each lot.

Density, Unit Type and Income Aligned Housing: The gross density of the development is 0.92 dwelling units per acre. Under Broomfield Municipal Code (BMC) Chapter 17-76 (Inclusionary Housing), all new residential projects must provide on-site affordable units. However, because this proposed development consists of fewer than 10 for-sale dwelling units, it is exempt from these requirements.

Public Land Dedication: The eight lots in the proposed subdivision trigger a public land dedication obligation of approximately 0.53 acres. Due to the small size of the required dedication, on-site land dedication may be determined to not be desirable in this location. The public land dedication will therefore be met with a cash-in-lieu payment.

Plugged and abandoned oil and gas well: The Broomfield Municipal Code Chapter 17-56 requires a maintenance and workover easement with access to the abandoned oil and gas well; the dimensions must be 50 ft in width and 100 ft in length. The final plat exhibit depicts the appropriate size for the access and maintenance workover easement. However, the applicant will be required to adjust the workover easement to ensure the well is centered within the easement area. The BMC exempts A-1(A) zoned properties from the required 250-foot setback from plugged and abandoned oil and gas wells.
