You can ask questions about the proposed changes below using the &ldquo;Questions&rdquo; tab or start a conversation and provide your feedback under the &ldquo;Comments&rdquo; tab at the bottom of the page.Your feedback will be used to help shape the proposed changes to the code to meet the needs of the community.<h2>Project Overview</h2>Staff is currently working on amendments to the Broomfield Municipal Code to support housing diversity within the City based on the findings of the <a href="https://www.broomfield.org/DocumentCenter/View/43254/Broomfield-Housing-Needs-Assessment_Full-Report_Sept-2023-1-1">2023 Housing Needs Assessment</a>. The proposed changes include renaming and modernizing the development standards within the R-3 Medium Density Residential District and R-5 High Density Residential District. These districts will now be named the medium-low density residential district and medium-low density residential district, respectively. The updates will also include the creation of a new residential district, the R-7 or High Density Residential District and changes to the PUD development standards within the municipal code. Additional information on the changes proposed within each district can be found below.Please note: this code update does not include any changes to the R-1 Low-Density Residential District and will not rezone any properties. Any property owners who may wish to rezone to the new or updated zone districts discussed below must go through a public hearing process. <h3 dir="ltr">R-3 Medium-Low Density Zone District</h3>The existing <a href="https://library.municode.com/co/broomfield/codes/municipal_code?nodeId=TIT17ZO_CH17-16MENSREDI">R-3 medium-density residential district</a> is proposed to be renamed the &ldquo;medium-low density residential district&rdquo; and updated with modernized development standards to allow townhomes, small lot single-unit, and smaller scale multi-unit proposals. As shown in the table below, setbacks, density and building height requirements are intended to be revised to support a wider range of housing units. The proposed updates include modifications to the permitted uses within the district as well as the specific development standards. The R-5 district currently only permits a maximum of 20 dwelling units per acre which the proposed ordinance would revise to 30 du/ac to allow for a moderate increase in density. The proposal also includes a revision to the maximum height from two stories to fifty feet (approximately four stories).The required on-site private open area is proposed to be reduced from 40% of the site to 15%. This reduction will allow for the construction of a greater number of units and will be less cost-restrictive on developers. Recent developments like North Park (Baseline), Dillon Pointe, Great Western Park, and The Ridge at Broomfield have all requested and received approval for variances from the uniform standards. Since residential developments in the PUD zone district almost always seek variances from the Uniform Standards for residential PUD plans, staff is recommending this section of the code be deleted.When new PUD plans are submitted in the future under the amended code, instead of comparing the proposed development standards for residential development to the uniform standards, staff will provide a comparison to other Broomfield zoning as applicable (R-1, R-3, B-1, etc). Since no recent PUDs have utilized the uniform standards, this change is not anticipated to impact future PUD proposals, but it will remove a section of the code that has become outdated because it no longer aligns with desired densities or anticipated development standards.The proposed changes would have no impact on existing residential development within PUD districts. The PUD plans approved for existing development will not be impacted. Existing neighborhoods, such as Anthem, Baseline, Red Leaf, Westlake, Highlands, and The Broadlands, have development standards incorporated into the individual PUD plan for each neighborhood and will remain in place as approved.<h2>Public Engagement</h2>Community feedback will be taken into consideration for elements of the proposed code update which the City and County of Broomfield has the authority to modify. Proposed 2025 Parking Code Update

You can ask questions about the proposed changes below using the &ldquo;Questions&rdquo; tab or start a conversation and provide your feedback under the &ldquo;Forum&rdquo; tab at the bottom of the page.Your feedback will be used to help shape the proposed changes to the code to meet the needs of the community.<h2>Project Overview</h2>The proposed Accessory Dwelling Units (ADU) code changes will address direction from Broomfield City Council (see the <a href="https://broomfield.org/4079/City-Council-Meetings">January 21, 2025 Study Session</a>), recent Colorado legislation, and to make technical edits to the existing code to clarify the use of terms such as &ldquo;mobile homes&rdquo; and &ldquo;tiny homes.&rdquo;Broomfield City Council approved an ordinance in 2019 allowing ADUs in any zone district in the city where single-unit dwellings are permitted. ADUs can create smaller and more affordable homes in existing communities. ADUs also help homeowners add value to their property or provide options for intergenerational living arrangements that support child or elder care and aging in place.Since 2019, the Colorado General Assembly passed legislation to permit ADUs statewide. Broomfield already permits ADU throughout the community. The proposed modifications would more fully align <a href="https://library.municode.com/co/broomfield/codes/municipal_code?nodeId=TIT17ZO_CH17-32ACBUUS_17-32-160ACDWUN">Broomfield&rsquo;s ADU code</a> with the new state legislation City and County of Broomfield staff have also identified several technical edits that would make the existing code easier to use. Broomfield City Council will review and vote on the proposed changes at public hearings, listed in the Key Dates at the top of this page.The proposed ADU code changes will address the following elements:<ul><li dir="ltr">Changes to some setback requirements for ADUs.</li><li dir="ltr">Changes to parking space requirements for ADUs.</li><li dir="ltr">Changes to some occupancy requirements for ADUs.</li><li dir="ltr">Technical changes, including defining the use of the terms &ldquo;tiny home&rdquo; and &ldquo;tiny house&rdquo; in Broomfield, and establishing regulations for their use.</li><li dir="ltr">Modifying other terms such as &ldquo;mobile homes&rdquo; and &ldquo;manufactured homes&rdquo; to clarify the difference between these structures and bring the definitions into line with the state&rsquo;s definition of these terms.</li></ul>While the community can provide input on the proposed ADU code changes, suggestions that conflict with state requirements cannot be implemented.<h3>Technical Edits: Tiny Homes, Tiny Houses and Mobile Homes<img src="https://s3-us-west-1.amazonaws.com/ehq-production-us-california/0f598904ac6ff2383c846c6ea738f6e5eb8124cf/original/1741020254/17aa1aa1464921dbcf4b530198753ed8_GettyImages-1407417136.jpg?1741020254" style="width: 300px;" class="fr-fic fr-dii fr-fir" alt="Tiny House used as Backyard Cottage"></h3>These proposed edits, unrelated to the new Colorado legislation, clarify the types of structures that can be used as an ADU in Broomfield. Currently, Broomfield&rsquo;s ADU code:<ul><li dir="ltr">Prohibits mobile homes, travel trailers, recreational vehicles, shipping containers, storage containers and other such temporary structures from being used as an ADU and<img src="https://s3-us-west-1.amazonaws.com/ehq-production-us-california/10c972c0f4d574a42155269dc469641850312804/original/1741020286/5d8aa2cc805bfd2a146fe3fc81f62674_GettyImages-175396430.jpg?1741020286" style="width: 300px;" class="fr-fic fr-dii fr-fir" alt="Tiny House used as Backyard Cottage (2nd example)"></li><li dir="ltr">Does not incorporate or define the terms &ldquo;Tiny Houses&rdquo; and &ldquo;Tiny Homes.&rdquo;</li></ul>Proposed changes to Broomfield&rsquo;s ADU Code supported by Broomfield City Council:<ul><li dir="ltr">Update the definitions used in the code to match the definitions used by the State of Colorado.</li><li dir="ltr">Provide a path to allow Tiny Homes to be used as ADUs in Broomfield.</li></ul>The code will still prohibit the use of mobile homes, RVs, shipping containers and other such temporary structures for use as an ADU.<h3>New Colorado Legislation: HB24-1152 Accessory Dwelling Units</h3>This bill aims to increase the availability of Accessory Dwelling Units (ADUs) in Colorado to address state housing shortages and housing affordability issues. While Broomfield already allows ADUs in all zone districts where single-unit dwellings are permitted, the new state regulations include several other provisions that Broomfield&rsquo;s current ADU regulations do not currently include or allow.<h4 dir="ltr">&ldquo;Restrictive&rdquo; Design</h4>The recent Colorado legislation defines &ldquo;restrictive&rdquo; design as being any zoning standard that does any of the following:<ul><li dir="ltr">Requires a stricter architectural standard (style, material, or landscaping) that is more restrictive for an ADU than for a single-unit detached dwelling in the same zoning district.</li><li dir="ltr">Requires the size of any ADU to be smaller than 500 square feet, or larger than 750 square feet.</li><li dir="ltr">Requires side setbacks for an ADU that are larger than the side setbacks for a primary dwelling unit in the same zoning district.</li><li dir="ltr">Requires a rear setback for an ADU that is larger than five feet.</li><li dir="ltr">Applies more restrictive aesthetic design or dimensional standards to accessory dwelling units that are factory-built residential structures than other accessory dwelling units.</li></ul>Impacts to Broomfield&rsquo;s ADU code:<ul><li dir="ltr">The proposed code update will include modifications to certain setback standards in some zone districts to avoid any instances of a &ldquo;restrictive&rdquo; setback.</li><li dir="ltr">Broomfield&rsquo;s code does not otherwise include any standards that would be considered &ldquo;restrictive&rdquo; and would need to be changed.</li></ul><h4 dir="ltr">Occupancy Requirements</h4>HB24-1152 prohibits local governments from requiring that an ADU be owner-occupied, with the following exceptions:<ul><li dir="ltr">A local jurisdiction may require a property owner to prove they reside on the parcel when an application is submitted:<ul><li dir="ltr">To construct or convert an ADU (this exception does not apply to an ADU that is being constructed simultaneously with a new primary dwelling unit).</li><li dir="ltr">For a license or permit for a short-term rental on the parcel through a local law or program.</li></ul></li></ul>Impacts to Broomfield&rsquo;s ADU code:<ul><li dir="ltr">Broomfield&rsquo;s current code requires the property owner to occupy as their primary residence either the principal structure or the ADU on the lot. This will need to be changed to meet the state requirements outlined above.</li><li dir="ltr">The Broomfield ADU code will still require property owners to prove residence at the time that an application is submitted to construct or convert an ADU, or to apply for a license for a short-term rental.</li><li dir="ltr">The code will also still prohibit ADUs for use as a short-term rental, meaning any nightly rental such as AirBNB.</li></ul><h4 dir="ltr">Parking Requirements</h4>The new Colorado legislation also limits local governments from requiring the construction of new off-street parking spaces for ADUs. Limited exceptions include:<ul><li dir="ltr">If no existing off-street parking is available (driveway, garage, etc.), parking restrictions may be allowed.</li><li dir="ltr">If the zoning district requires parking for a primary residence, but the block does not allow on-street parking, parking restrictions may be permitted.</li></ul>Changes to Broomfield&rsquo;s parking code as a result of the new Colorado legislation will be addressed by the concurrent <a href="http://broomfieldvoice.com/2025ParkingCodeUpdate">2025 proposed parking code update</a>.<h3 dir="ltr">Broomfield City Council Guidance</h3>At the January 21, 2025 <a href="https://broomfield.org/4079/City-Council-Meetings">City Council Study Session</a>, Broomfield City Council expressed their support to move forward with modifications to Broomfield&rsquo;s code. City and County of Broomfield staff are preparing a draft ordinance for Broomfield City Council to consider. Share your ideas about how this development application might be improved to better serve the community, leave comments that will be shared with City Council and/or ask questions about the proposal using the tabs below.<h2>Project Overview</h2>The Broomfield Housing Alliance has submitted a proposal for a new, 55-unit income aligned housing community located at 6900 and 7000 W 119th Avenue. The site is one block south of W 120th Avenue, and one block west of Main Street.This development application will be competing for Low Income Housing Tax Credits from the Colorado Housing and Finance Authority in February 2026. Should this development be awarded tax credits, Broomfield Housing Alliance and Blueline Development plan to move forward with a formal Site Plan application to the City.<h3>Project Details</h3>Applicant: Broomfield Housing Alliance Location: 6900 and 7000 W 119th Avenue Project Type: Income aligned housing development<h3>City and County Staff Analysis</h3>Zoning, Surrounding Uses and Comprehensive Plan: The subject parcels are zoned PUD and are a part of the Vista Pointe PUD Plan. This PUD was amended in June, 2024 to add income aligned multi-family residential as a permitted use on these two lots.The comprehensive plan land use designation for these two properties is Mixed-Use Commercial. Income aligned multi-family residential is consistent with this land use designation.There are a mix of uses surrounding this property. These include residential and commercial (retail, office and flex warehousing) uses. There is another existing residential use to the west (The Friends of Broomfield home).Site Circulation, Parking and Multimodal Access: The conceptual proposal for this development includes access from W 119th Avenue. The proposal includes 55 parking spaces, including 2 EV-installed parking spaces.The project is proposed to include bike storage and a maintenance room. The project site is located one block west of the RTD bus route 120 stop on Main Street, and is approximately 0.6 miles walking distance to the potential Northwest Rail/Front Range Passenger Rail station at W 116th Avenue.This proposal includes a potential variance for parking. The need for this variance is under review by staff and may change pending any updates to the Broomfield parking code.Income Aligned Housing, Density, and Unit Type: The project description submitted by the applicant outlines that the project includes 55 units for households earning between 30%-60% AMI. This is approximately 30 dwelling units per acre on a 1.82 acre site. The building includes a mix of 1-bedroom, 2-bedroom, and 3-bedroom units, targeted for working families.Landscaping, Open Lands, Parks and Trail Amenities: The proposed site plan includes 24,922 square feet of Open Area including a courtyard that would include a community garden, playground, tables and seating, and other amenities for residents.Public Land Dedication: The conceptual plan includes a proposed public land dedication of 0.38 acres. The PLD can potentially be met with an on-site dedication or a cash-in-lieu payment depending on the site-specific context. This is a new development proposal! This project is currently under review and will be scheduled for hearings in accordance with the application review process timeline. This page can be utilized to stay up to date with the proposal and provide feedback on the request.<h2 style="text-align: left;">Project Overview</h2>This is a proposal for a flex building to be located at 10355 W 120th Avenue within the Knudson subdivision and Planned Unit Development (PUD) plan area. The building will be 28 feet tall and approximately 122,000 square feet with loading docks on the east and west elevations. Anticipated uses for the building include light industrial, office and warehousing uses. This is consistent with the PUD plan for the property. Parking will be provided to the north, south, east and west of the building with an anticipated 224 spaces. This parking count exceeds the minimum required spaces but does not surpass the parking maximums as established within the Broomfield Municipal Code.Access to the project site will be along W 120th Ave to the south and detention will be provided in the northeast corner of the site. Landscaping will be provided throughout the site consistent with the city landscape code. The northern portion of the site will include retaining walls to help manage the grade change on the property. The existing sidewalk along Interlocken Loop to the north will be extended but is not anticipated to provide a direct connection to this parcel due to the elevation change.This site was previously approved for a <a href="https://www.broomfieldvoice.com/ups-distribution">UPS Facility</a> that received approval but did not move forward to construction.<h3 style="text-align: left;">Project Details</h3>Applicant: Silverpoint Development, Alcorn Construction Location: 10355 W 120th Avenue Project Type: Commercial - Flex Industrial<h3 style="text-align: left;">City and County Staff Analysis</h3>Zoning, Surrounding Uses and Comprehensive Plan: The zoning for this parcel is Planned Unit Development (PUD) and the property is located within the Knudson PUD Plan area. The PUD plan document allows for a wide variety of business and industrial uses to occur on the parcel including but not limited to offices, research facilities, manufacturing, medical offices and clinics, laboratories and retail sales.The comprehensive Plan land use designation for the subject property is commercial. The proposal is consistent with that designation.The adjacent property to the west is also located within the Knudson PUD Plan area and is developed as a flex industrial facility. The parcel to the east is currently vacant. The Rocky Mountain Metropolitan Airport is located to the south of the property.Architecture: The proposed building is 28&#39; tall and features a neutral color scheme. The Comprehensive Plan land use designation for this parcel is Industrial. Auto Repair is consistent with this land use. Site Circulation, Parking and Multimodal Access: Under this proposal, customers would access the site from West 116th Avenue on the north side of the site. Storage, as well as trash and recycling, would be located behind the building and behind a gate and a fence with a second entrance entrance on Teller Street. Landscaping: Landscaping for this project will be reviewed in accordance with Broomfield&#39;s Landscape Code and Tree Preservation code. Potential Variances: The applicant has requested a variance for the width of the landscape buffer along Teller Street, and to provide additional shrubs and bushes in lieu of some required trees. These requests are being reviewed as a part of the Formal Review for this project. The new development is proposed east of Indiana Street and south of State Highway 128, immediately west of the Ridge at Broomfield. In addition to a Planned Unit Development Plan, a site development plan and final plat would be required. The site plan would reflect the improvements related to the apartment complex, and park.<h3 id="project-details-2">Project Details</h3>Location: South of State Highway 128, east of Indiana Street, west of Ridge ParkwayProject Type: Multi-unit ResidentialApplicant: Embrey and Norris DesignProject Description: The concept plan review of a proposed 362-unit apartment complex with a 9-acre public park<h3>City and County Staff Analysis</h3>Consistency with Zoning: The property is zoned Planned Unit Development (without a plan). A PUD Plan that establishes uses, site layout, setbacks, architectural design, and other development standards would be required.Consistency with the Comprehensive Plan and Compatibility with Surrounding Uses: The property is identified as &quot;residential&quot; per the Comprehensive Plan. The proposed use for the property is consistent with the Comprehensive Plan and compatible with the surrounding uses. The Ridge at Broomfield, a multi-use development east of this site, includes two apartment complexes, detached single-unit homes, and two office buildings. The Town of Superior is to the north of the subject property. There is a single-unit residential subdivision to the north and east of the site on the north side of State Highway 128 (SH128) in Superior, with Coyote Ridge Open Space bordering the northern side of SH128.The property west of the site is zoned PUD (without a plan) and is designated as &quot;open lands&quot; per the Comprehensive Plan. The City and County of Broomfield owns the property to the south, which has the Great Western Park reservoir.Long-Range Financial Plan: The proposed use is consistent with land use assumptions in the long-range financial plan.Conceptual Sustainability Elements: Sustainability elements have not been finalized at this stage of the process. Staff will work with the applicant on incorporating sustainable practices into the formal development plans if the project proceeds past the concept stage.Inclusionary Housing and Public Land Dedication: In compliance with the inclusionary housing requirements, the applicant has set aside 20% or 72 units at 60% AMI with a 40-year deed restriction.Possible Key Issues: Staff has preliminarily identified the following key issues:<ul><li>Parking - The concept plan indicates 456 parking spaces will be provided via carports, garages, and surface lots. This proposal is overparked by approximately 114 spaces. Broomfield encourages providing only the minimum parking spaces required per the <a href="https://library.municode.com/co/broomfield/codes/municipal_code?nodeId=TIT17ZO_CH17-32ACBUUS_17-32-040OREPARESP">Broomfield Municipal Code, Chapter 17-32-040</a>. Overparking uses additional land that could be integrated into the park, community gathering spaces, or open areas. This further helps to maintain an efficient and well-planned development.</li><li>Access - The concept plan shows a 3/4 turn access point from SH128. Typically, a secondary access is required, but the development team has met with the North Metro Fire District to request a variance to this requirement. The Colorado Department of Transportation (CDOT) controls access to State Highway 128. At maximum, a 3/4 turn access point would be acceptable to CDOT at the westernmost side of the property, with any potential secondary access being a right-in-only. The concept plan currently shows the 3/4 turn access point at the western side of the property without the secondary access shown. CDOT has indicated it would be ideal to get a connection from Indiana Street. A 3/4 access point on State Highway 128 would prevent access to Indiana Street for this development.</li><li>Grading - The applicant&#39;s project narrative indicates that multiple retaining walls (10 ft- 20 ft in height) will be required due to the site&#39;s steep topography. This will lead to the site being extensively terraced with retaining walls. As currently shown, there are five large retaining walls needed to terrace the site, with shorter walls likely to be added as the design develops. Additionally, the concept plan depicts steep grades for the roadway at eight percent. This exceeds the allowance for emergency service access, but it appears there is potential for minimizing the grade closer to five percent.</li><li>Utilities - A secondary water line connection will be required in addition to connecting to the existing water line stub to the east. This proposal shows a lift station, which Broomfield will require to be privately owned and maintained, in addition to the sewer network that drains to it. The private lift station will have to pump to Broomfield&#39;s gravity sewer system, likely to the stub that is on the property immediately to the east. This private lift station would require approval by the State of Colorado&#39;s Department of Public Health and Environment, which can be a multi-year process. With previous concept plans, prior applicants have attempted to get easements on the property immediately to the east, specifically for utility connections. Historically, that has been challenging, but the current applicant has indicated that progress is being made. If easements are not granted, then utility connections would become more complicated and require further analysis by the applicant in coordination with Broomfield staff.</li></ul>If the applicant opts to proceed with a formal application for development of the site, Broomfield staff will work with the applicant to address these issues.Public EngagementYou can engage with this project using the Questions and Comments tabs below, or by emailing <a href="mailto:planning@broomfield.org">planning@broomfield.org</a>. <h2>Why is waste management important to sustainability in Broomfield?</h2>For most people, &ldquo;throwing away&rdquo; a piece of trash seems like the end of the story, but a complex system of collection, distribution, reuse, and eventual disposal is only the beginning for a discarded item.Each year, Broomfield produces more than 75,000 metric tons (MT) of solid waste and only 23% is diverted from landfills. This represents a significant environmental, public health and economic opportunity.Landfill waste produces greenhouse gases that contribute to climate change and impact our local air quality. Improperly disposed hazardous materials can threaten our water quality while representing an economic loss of valuable materials.Today, we have opportunities for large-scale improvements in composting, commercial recycling, and changes in our construction and demolition waste management systems. By reducing the amount of waste we generate and maximizing the amount of materials diverted from landfills, we can conserve resources, create economic opportunities and improve the health of our community. <h2>Where are we Right Now?</h2>Broomfield has a long way to go to catch up with our neighboring communities along the Front Range. Fortunately this means there is ample opportunity to improve our diversion rate in the near term.<table class="noBorder" style="width: 100%;"><tbody><tr><td style="width: 49.9495%;">Zero Waste Project Update: Spring 2021. Broomfield is making progress! Quality data is the foundation of any performance-based project. Broomfield&#39;s original waste diversion estimate (based on limited sample data) was 12%. These two foundational policies established zero waste as a priority, created a data tracking system for haulers, and set goals for the community of 50% diversion by 2025, and 100% diversion (or darn near!) by 2035.In 2021, Broomfield initiated a strategic planning effort that included both GHG reduction and zero waste as key topics.
